Terms and Conditions/Contract for Services

All services (as defined below) offered by Keys Shuttle Service, LLC dba Keys Shuttle dba and its affiliates are subject to the following Terms of Service (“Terms”). By agreeing to these Terms, you acknowledge and agree to be bound by the conditions of use listed below, and any future revisions and additions, as published at: https://keysshuttle.com/terms-and-conditions/ and becomes a binding contract.

Keys Shuttle’s services (the “Services”) consist of providing transportation reservation services via website and over the phone, to individual users and payment collection services of fees and expenses from users for the Services. Your decision to book a reservation and or to accept transportation services is at your sole discretion.

Reservations

About Reservations

When making a booking or registering an account profile on our site, as appropriate, you may be asked to enter your name, email address, mailing address, credit card information or other details to help you with your experience.

When do we collect information?

To confirm a Shuttle reservation, a valid credit card is required to be added to the clients profile at the time of booking. All credit card details are stored securely via our online portal. Your credit card will be charged at the time of booking, not on the day of travel.

Communication
We cannot accept any reservation that doesn’t have the passengers cell phone, email, etc…Flights run early and late and our dispatch team may need to contact you.

By providing your cell phone number during the reservation process, you agree to allow Keys Shuttle to call and/or text information regarding your reservation details. However, Keys Shuttle drivers are not required to call passengers in advance of the pickup.

By making a reservation you are consenting to text and or email communications.

Customer’s Responsibility To Provide Accurate Information

Customers are responsible for providing accurate information at time of booking. Please note we can not accept any reservation to and from airports without flight details (airline flight number, arrival and or departure times). Passengers are responsible for providing accurate flight information, including airline and flight number. When providing travel information, the customer agrees that the information will be accurate. Keys Shuttle is not responsible for mistakes made by customers while using its official websites, reservation platforms or over the phone. Confirmation emails are provided at the time of booking to allow customers to review details of their reservation in advance of the reservation. Passengers are responsible for correct reservation selection of pickup/drop-off times to meet their individual travel needs, and to provide corrections or updates to their reservations if necessary. Keys Shuttle shall not be held accountable and is not responsible if a passenger chooses a reservation time that does not afford them sufficient time for travel, to clear security and board their flight punctually/on time.

Reservation Changes; Excessive changes to your reservation less than 48 hours before your travel time may incur additional fees.

Payments

When you submit an online reservation for a shuttle reservation, your credit card is going to be charged immediately. The payment receipt is going to say “Keys Shuttle Service LLC.”

If you do not wish to make an online booking and would rather make your booking over the phone, there is a $10 fee for all telephone reservations.

Cancellations

We operate just like every major airline. You will have 24 hours from the time you make this booking to cancel and request a full refund, with exception to travel time within the 24 hour period.

We understand that your plans may change. We will try and accommodate your change request as best we can. If you cancel your booking within 24 hours of making your reservation, a full refund will be issued.

If you book your reservation for travel within the 24 hour period there are no cancellations/refunds.

Cancellations made within 24 hours of travel and or same day cancellations are non-refundable. No-Shows arenon-refundable.

After 24 hours, you may make date, time and name changes for free one time, thereafter there is a $10.00 change fee. If you wish to cancel more than 24 hours after making your booking, the booking is non-refundable and you will only be issued a trip credit for future booking(s) – Credits are good for a period of 12 months from original booking date. Trip credits can be transferred to anyone else.

Rates

Tolls, taxes, and other fees are included in the cost of the ride. Gratuity is not. Our drivers keep 100% of the gratuity, tip is always welcomed and appreciated.

Luggage

Each passenger is allowed one (1) standard piece of luggage plus one (1) carry on. Fees apply for all oversized pieces of baggage or excess luggage. Undeclared luggage will be charged an additional penalty or denied based on space available.

Keys Shuttle is not responsible for lost, damaged, or stolen baggage, or for any items left on the shuttle at the end of your service. It is your responsibility to collect your baggage and personal items at the end of your trip.

Operational Issues

In the event of unforeseen and or uncontrollable circumstances such as accidents, medical emergencies, traffic, traffic accidents and/or weather, technology issues, and or communication issues an interruption in service with delays may occur. Keys Shuttle is not liable or responsible for any and all costs associated with customer’s travel such as but not limited to; missed flights and or as a result of missed flights, rebooking fees, alternate travel costs, etc…Keys Shuttle cannot provide alternate transportation suggestions. There are no refunds due to unforeseen and or uncontrollable circumstances as discussed in this section.

Travel Time

Shared ride shuttles typically take longer than black car or private charter service due to servicing multiple pick-ups, drop-offs, and possible use of a transfer point. Travel time is also dependent on geography, weather conditions, time of day, and traffic conditions. Because of these variables, we cannot provide an exact duration of travel time. Keys Shuttle is not liable or responsible for any fees and or costs associated with customer’s travel such as but not limited to; missed flights and or as a result of missed flights, rebooking fees, alternate travel costs, etc…Keys Shuttle cannot provide alternate transportation suggestions. There are no refunds due to travel time circumstances as discussed in this section.

Pick Up Procedures

MIA

Pick up is at ground level. When you have retrieved your checked luggage Exit through door 7 or 11 ARRIVALS and cross the crosswalk between doors 7 and 11, cross TWO SETS of lanes (first set is for taxis, second is for private vehicles), to the wide median, to your right you will see a waiting room with a glass wall, just to the left of the waiting room is our sign “KEYS SHUTTLE”. Keys Shuttle drivers are not required to call passengers in advance of the pickup. Shuttles will depart MIA on schedule whether all passengers are onboard or not. If your flight gates at MIA less than 20-minutes before your scheduled departure time, the shuttle may not wait before departing. If you are unable to board the shuttle at your scheduled time, you may be able to reschedule to the next available shuttle pickup.

FLL

Pick up is at Ground Level. When you have retrieved your checked bags (if applicable). Exit the building pick up is between Terminals 1 & 2. We will be near a sign that reads “LIMO MINIBUS SEDAN VAN RIDE SHARING”. Look for our Sprinter Van that say Keys Shuttle. Keys Shuttle drivers are not required to call passengers in advance of the pickup. Shuttles will depart FLL on schedule whether all passengers are onboard or not. If your flight gates at FLL less than 20-minutes before your scheduled departure time, the shuttle may not wait before departing. If you are unable to board the shuttle at your scheduled time, you may be able to reschedule to the next available shuttle pickup.

EYW

Pick up is at ground Level. When you retrieve your baggage exit baggage claim to your right, where you’ll find the designated area for shuttles, limos, and ride-sharing services like Lyft and Uber.Look for our Sprinter Van that say Keys Shuttle. Keys Shuttle drivers are not required to call passengers in advance of the pickup. Shuttles will depart EYW on schedule whether all passengers are onboard or not. If your flight gates at EYW less than 20-minutes before your scheduled departure time, the shuttle may not wait before departing. If you are unable to board the shuttle at your scheduled time, you may be able to reschedule to the next available shuttle pickup.

Non-Airport Pick Up Procedures

Non-Airport Pick Up Procedures. We provide door to door service throughtout th eFlorida Keys. What that means is we pick you up at the address you proivede us with to pick you up from (House, Condo, Resort, Hotel, etc…)When you select a time for pick-up, your pick-up will be scheduled. This pick-up time and the scheduled run time selected at booking may be different. You will receive an email and/or text message the night before your trip with your exact pickup time.

e.g. if you select the 7:00am shuttle, your exact pickup time may be as early as 6:30am or as late as 7:30am depending on the number of passengers on that pick-up route

Our system will also send you an automated text when the shuttle is on its way. Keys Shuttle drivers are not required to call passengers in advance of the pickup. Please be advised that the shuttle cannot wait and will depart Five (5) minutes after the scheduled pick-up time/arrival. No shows are chargeable and non-refundable.

OTHER TERMS AND CONDITIONS

Safety

Vehicles cannot be loaded beyond legal seating capacity at any time.

All passengers are required to wear seatbelts while on-board. We reserve the right to refuse service to any passenger who refuses to wear a seatbelt.

Shuttle vehicles are exempt from Florida’s child passenger safety laws. However, this does not mean children are any safer traveling in these types of vehicles. It is always the safest option to use car seats and booster seats, even in exempt vehicles. Keys Shuttle does not provide any car seats or booster seats. In the event that a passenger brings their own, a responsible adult accompanying the child(ren) is responsible for the installation and use of the seat.

The Chauffeur is responsible for the Safety of the passenger and the vehicle. The Chauffeur has the right to remove any passenger from the vehicle at anytime they deem is comprising the safety and or comfort of other passengers. If you are removed from the shuttle, Keys Shuttle is not liable or responsible for any fees and or costs associated with customer’s travel such as but not limited to; missed flights and or as a result of missed flights, rebooking fees, alternate travel costs, etc…Keys Shuttle cannot provide alternate transportation suggestions. There are no refunds due to travel time circumstances as discussed in this section.

Pets

We are pet friendly. You must provide pet travel information at the time you make the reservation. All pets must be transported in an approved animal carrier/crate. Animals will not be permitted to ride in the cabin unsecured with the exception of Service Animals protected by ADA and may directly accompany their handler as per law.. Cleaning fees will apply for any mess caused by your pet (e.g. excessive pet hair, urine, or feces). You must let reservations know if you intend to travel with a pet.

Smoking/Alcohol/Vaping/Drug Use

Smoking, Alcohol, Vaping, and or Drug Use is strictly prohibited in any of our Vehicles. A minimum of a $500 fee will apply for violations of this policy, and you will be removed from the vehicle.

Assumption Of Risk, Waiver Of Liability and Indemnification AGREEMENT

This Waiver and Release of Liability (hereinafter, the “Agreement”) is being entered into in consideration of, and for the benefit for, transportation services offered by Keys Shuttle Service LLC, and for other good and valuable consideration, the receipt and sufficiency of which is acknowledged, by I, the undersigned, on behalf of myself and those in my party (hereinafter individually and collectively referred to as the “Passenger(s)”). I, the Passenger(s), hereby acknowledge, represent, warrant and agree as follows;

Voluntary Participation. Passenger(s) understands, acknowledges, and confirms by making reservation and/or hiring Keys Shuttle Service LLC for their transportation needs participation is fully voluntary. Passenger(s) hereby warrants that he or she or they is/are in good health and suffers from no physical or mental condition that would create an unreasonable and/or foreseeable risk of harm to himself or herself, or to any other passenger(s).
COVID-19/Communicable and contagious disease/viruses. Passenger(s) acknowledge the contagious nature of COVID-19 as well as other communicable and contagious disease/viruses.
Passenger(s) voluntarily assume the risk and are responsible for any and all exposer to and/or infected by COVID-19, other communicable and/or contagious diseases/viruses by hiring/using Keys Shuttle Service LLC. Further, Passenger(s) acknowledge that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 and or any other communicable and or contagious disease/virus by hiring and or using Keys Shuttle Service LLC transportation service(s) may result from the actions, omissions, or negligence of myself and others, passengers, including, but not limited to, Keys Shuttle Service LLC employees, and/or representatives. Passenger(s) voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that Passenger(s) may experience or incur in connection with the hiring/use of Keys Shuttle Service LLC transportation service(s). On behalf Passenger(s), Passenger(s) hereby release, covenant not to sue, discharge, and hold harmless Keys Shuttle Service LLC, its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. Passenger(s) understand and agree that this release includes any Claims based on the actions, omissions, or negligence of Keys Shuttle Service LLC, its employees, agents, and representatives, whether a COVID-19, communicable and/ or contagious disease/virus infection occurs before, during, or after hiring/using Keys Shuttle Service LLC transportation service(s).
Passenger(s)agree to abide by any and all local, state, and/or federal laws with regards to COVID-19, communicable and/or contagious disease/virus. Including but not limited to wearing a mask at all required and necessary times.
Comprehension and Assumption of Risk. Passenger(s) understands and acknowledges that there are potential risks involved related to transportation. Passenger(s) hereby assumes all risks, known and unknown, foreseeable and unforeseeable, in any way connected with Passenger(s) participation in the Events. Passenger(s) accepts full responsibility for any liability, injury, loss, damage or death in any way connected with the transportation service provided by Keys Shuttle Service LLC. Passenger(s) acknowledges that by making a reservation, hiring and/or using Keys Shuttle Service LLC transportation service is at Passenger(s)’s sole risk.
Passenger(s) assumes the risks associated with traveling to and from location(s). Passenger(s) assumes the risk of any and all dangers presented on and in the street, sidewalk, or other areas, including but not limited to any and all traffic..
Release of Claims. Passenger(s) hereby releases Keys Shuttle Service LLC from any and all liability or claims which may arise from the reservation process and the transportation service(s) provided by Keys Shuttle Service LLC. This paragraph shall be inclusive of, but not limited to, any injury or death resulting from theft of or damage to Passenger(s), Passenger(s)’s property, transportation, traffic accident, as well as any exposure to adverse weather conditions. Passenger(s), on behalf of Passenger(s) and Passenger(s)’s successors, designees, agents or assigns, hereby forever and unconditionally releases Keys Shuttle Service LLC, its owners, officers, employees, agents, successors in interest and insurers (hereinafter referred to as the “Released Entities”), from any and all claims, actions, damages, liabilities, losses, costs, and expenses, including, without limitation, attorney’s fees, in any way arising out of, or resulting from, Passenger(s)’s reservation, hiring and/or using Keys Shuttle Service LLC transportation service(s). Passenger(s) further acknowledges that Keys Shuttle Service LLC is in no way liable for any injury to resulting from Passenger(s)’s own conduct or behavior.
Medical Expenses and Consent to Medical Treatment. Passenger(s) hereby accepts full financial responsibility for any personal medical expenses or treatment which may result from hiring and/or using Keys Shuttle Service LLC transportation service(s) and hereby releases Keys Shuttle Service LLC in full from any potential claim for such medical expenses. Further, Passenger(s) hereby authorizes Keys Shuttle Service LLC to provide Passenger(s) with medical treatment, whether resulting from an emergency or otherwise, and hereby releases Keys Shuttle Service LLC from any and all actions in tort for the provision of such medical attention. Nothing in this paragraph shall be construed to create an actual or implied duty upon Keys Shuttle Service LLC to provide or seek such medical treatment for Passenger(s).
Indemnification. Passenger(s) agrees to pay any and all costs, fees, expenses and charges arising from any act or conduct of Passenger(s) that results in damage or injury to any person, including, but not limited to, any third party and/or employee of Keys Shuttle Service LLC. Participant further agrees to indemnify and hold Keys Shuttle Service LLC harmless from and against any such act or conduct which results in damages of any kind.
Promotional Release. Passenger(s) hereby grants Keys Shuttle Service LLC a worldwide, royalty-free irrevocable license to use Passenger(s)’s photographic, video, or digital likeness for promotional, educational, and/or commercial purposes. This Paragraph shall, however, be limited to pictures, videos and descriptions of events which are captured in the course of services rendered, or within a reasonable time thereof. Participant can opt out from providing permission for the Promotional Release discussed herein by providing notice, in writing, to Keys Shuttle Service LLC.
Passenger(s) acknowledges that he or she has carefully read this Agreement and submits to all of the foregoing provisions before making reservations/booking. Further, Passenger(s) fully understands when making a reservation I/we are agreeing to all terms, and understand I/we are giving up substantial rights, including my/our right to sue.
Passenger(s) expressly agrees to all terms and conditions including the foregoing waiver and assumption of risks agreement which is intended to be as broad and inclusive as is permitted by the law of the State of Florida. This becomes a binding contract at the time the reservation is made and or paid for.
Passenger(s) agrees if any portion of these terms and conditions is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect. Passenger(s) acknowledge by making reservation, hiring/using Keys Shuttle Service LLC transportation service(s) Passenger(s) are agreeing to all terms and conditions and I/we are signing the agreement freely and voluntarily, and unconditionally release Keys Shuttle Service LLC of any all responsibility and or liability to the greatest extent allowed by law.
